A real estate transaction is complicated enough, but selling a home during a divorce further complicates matters. Costly housing mistakes can be prevented during a divorce but cannot be reversed or corrected after. This is why you need a real estate specialist that has the experience and knowledge to help you navigate through these times.
The Superior Courts of California have appointed me as a 730 Expert. As the court’s expert, I have been appointed to take over real estate transactions from other real estate agents who were unable to complete the transaction.
KEY FACTORS
There are several key factors that you need to consider when selecting a real estate agent to handle your transactionS
Such as:
- Neutral Third Party – Being able to maintain neutrality amongst the parties involved. This is not the time to choose a family member or friend. Typically they will lean towards one of the spouses creating additional conflict.
- Communication – The agent needs to ensure that effective and consistent between all parties.Â
- Fiduciary Responsibility – Ensure that the agent understands their fiduciary responsibility to obtain the highest selling price for your home and not use the distress of the divorce to selling quickly at a low price.
- Experience – the agent needs to know how to handle situations when one party is not cooperating with the Court’s order or Stipulation. This saves on attorney fees, time, and stress.
- Repair Program – Often, a home will fall into disrepair since the parties do not want to use their money to make repairs. Using our repair program, we can help the parties complete necessary repairs, which can be paid at the close of escrow utilizing a portion of the sale proceeds. Typically we can get 2 to 3 times more than the costs back.
- Distribution of Sales Proceeds – At the close of escrow, the parties may need moving costs and monies for rent. Furthermore, we need to make sure that the funds are distributed to according to the court order, which may indicate that the funds go to an attorney’s trust account and split between the parties.
- Relocation Assistance – One or both parties may want to purchase a new home or need to rent. Planning ahead and knowing the costs of leasing buying a new home is essential.
